Terms of Service

These Terms of Service ("Terms") govern your use of our community platform ("Service"). By creating an account or using the Service, you agree to be bound by these Terms.
1. Eligibility
You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
2. Account Registration
2.1 Account Creation
To use the Service, you must create an account by providing a valid email address and username, or by signing in through Google or Apple. You agree to:
- Provide accurate and complete information
- Maintain the security of your password and account
- Notify us immediately of any unauthorized use of your account
- Not create multiple accounts for deceptive purposes
2.2 Account Responsibility
You are solely responsible for all activity that occurs under your account. We are not liable for any loss or damage arising from your failure to maintain the security of your account credentials.
3. Acceptable Use
3.1 You Agree To
- Treat other users with respect
- Post content that is truthful and not misleading
- Use the Service in compliance with all applicable laws and regulations
- Respect the intellectual property rights of others
- Follow community-specific rules and guidelines set by community moderators
3.2 Zero Tolerance for Objectionable Content and Abusive Behavior
Geniousing Community has a zero tolerance policy for objectionable content and abusive behavior. Any user found to be posting objectionable content or engaging in abusive behavior will have their account terminated immediately and may be reported to the appropriate authorities.
3.3 You Agree Not To
- Harassment: Bully, threaten, intimidate, or harass other users
- Hate speech: Post content that promotes hatred or violence against individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
- Spam: Post unsolicited commercial content, chain messages, or repetitive content
- Misinformation: Deliberately spread false or misleading information
- Illegal content: Post content that is illegal or promotes illegal activities
- Violence: Post content that glorifies or incites violence
- Inappropriate content: Post sexually explicit material, graphic violence, or other content inappropriate for the community context
- Impersonation: Impersonate another person or entity
- Manipulation: Artificially inflate engagement metrics (likes, views, etc.)
- System abuse: Attempt to gain unauthorized access, reverse engineer, or interfere with the Service's infrastructure
- Data harvesting: Scrape, collect, or harvest user data without authorization
3.4 Report Categories
Users may report content that violates these Terms. Reports are categorized as: spam, harassment, inappropriate content, misinformation, hate speech, violence, illegal content, or other. All reports are reviewed by our moderation team.
4. User Content
4.1 Ownership
You retain ownership of the content you post on the Service (threads, comments, messages, images, poll content). By posting content, you grant us a non-exclusive, worldwide, royalty-free license to host, display, distribute, and make your content available to other users as part of the Service's normal operation.
4.2 Content Standards
All content must comply with the Acceptable Use rules in Section 3. We reserve the right to remove content that violates these Terms, without prior notice.
4.3 Image Uploads
You may upload images in JPEG, PNG, GIF, or WebP format, up to 10 MB per file. You represent that you have the right to upload any images you submit and that they do not infringe on any third party's rights.
4.4 Direct Messages
Direct messages are private between participants. We do not actively monitor the content of direct messages, but they may be reviewed if reported by a participant for violations of these Terms.
5. Communities
5.1 Community Creation
Users may create communities on the Service. Community creators and designated moderators are responsible for enforcing community-specific rules in addition to these Terms.
5.2 Public and Private Communities
Communities may be public (visible and joinable by all users) or private (restricted membership). Content posted in public communities is visible to all users.
5.3 Moderation
Community moderators may remove content, manage membership, and enforce rules within their communities. Moderator actions must comply with these Terms and must not be used to harass or unfairly target users.
6. Polls
Users may create polls within threads. Poll votes are recorded and associated with your account. Poll creators can configure polls to allow single or multiple selections. Polls have a configurable duration (up to 7 days), after which voting closes.
7. Notifications
The Service may send you notifications including:
- In-app notifications about activity on your content
- Push notifications to your mobile device (if enabled)
You can manage notification preferences in your account settings at any time, including disabling all notifications entirely.
8. Intellectual Property
8.1 Our Rights
The Service, including its design, features, code, and branding, is owned by us and protected by intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or branding.
8.2 Copyright Complaints
If you believe content on the Service infringes your copyright, please contact us with:
- Identification of the copyrighted work
- Identification of the infringing content and its location on the Service
- Your contact information
- A statement of good faith belief that the use is unauthorized
- A statement under penalty of perjury that the information is accurate and you are the copyright owner or authorized to act on their behalf
9. Account Termination
9.1 By You
You may delete your account at any time through your account settings. Account deletion removes your user data from our system. Some content you posted in public communities may remain in an anonymized form.
9.2 By Us
We reserve the right to suspend or terminate your account at any time if you:
- Violate these Terms
- Engage in activity that could harm other users or the Service
- Create legal liability for us
We may also terminate inactive accounts after extended periods of inactivity, with prior notice.
10. Disclaimers
10.1 "As Is" Service
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10.2 No Guarantee
We do not guarantee that the Service will be uninterrupted, secure, or error-free. We are not responsible for any content posted by users.
10.3 Third-Party Services
The Service integrates with third-party services (Google, Apple, Firebase). Your use of those services is governed by their respective terms and privacy policies. We are not responsible for the practices of third-party services.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:
- Your use or inability to use the Service
- Any unauthorized access to or alteration of your content or data
- Any content posted by other users
- Any interruption or cessation of the Service
12. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms.
13. Changes to These Terms
We may modify these Terms at any time. We will notify users of material changes by posting the updated Terms with a new "Last Updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms. If you disagree with any changes, you should stop using the Service and delete your account.
14. General Provisions
14.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.
14.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
14.3 Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
14.4 Assignment
You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
